What is Act 25?
On September 22, 2023, the legislative amendments introduced by the Modernization Act on Personal Information Protection provisions came into effect. These adjustments, outlined in act 25, aim to reform the Private Sector Personal Information Protection Act, especially concerning aspects related to criminal sanctions.
The Access to Information Commission has developed an implementation framework that encompasses various issues, including those related to criminal sanctions.
Penalties
An individual who violates the law may be subject to a fine ranging from $5,000 to $100,000. In other situations, such as those involving a legal entity, the latter may face a fine ranging from $15,000 to $25,000,000, or an amount equivalent to 4% of its global turnover from the previous fiscal year, if this amount is higher.
